Firearms Sale & Checkout Agreement

This Firearms Sale & Checkout Agreement (“Agreement”) establishes the legal terms and responsibilities that apply to all firearm and serialized item purchases made through Battle Creek Firearms Co., whether purchased in-store or online for local pickup or nationwide shipment. By purchasing or attempting to purchase a firearm from us, you acknowledge that you have read, understood, and agreed to comply with this Agreement.

Firearms are regulated products subject to strict federal, state, and local laws. All transactions must follow these laws without exception.

Eligibility and Legal Compliance

By proceeding with a firearm purchase, you represent and certify that you are legally permitted to own and possess firearms. You confirm that you meet all applicable legal requirements and are not prohibited from purchasing or possessing firearms under any law.

You affirm that you:

  • Meet all minimum age requirements
  • Are legally eligible to purchase and possess firearms
  • Have provided truthful and accurate information
  • Are not restricted due to criminal history, restraining orders, or other legal prohibitions
  • Will comply with all federal, state, and local regulations

Providing false or misleading information may result in order cancellation and may violate the law.

FFL Transfer Requirement

All firearms and serialized receivers must be transferred through a licensed Federal Firearms License (FFL) dealer. Firearms cannot be shipped directly to a non-licensed individual.

For shipped orders, you agree to select or provide a valid FFL dealer who will receive the firearm on your behalf. The firearm will be shipped only after the dealer’s license has been verified. You are responsible for coordinating with the dealer and completing all required paperwork at the time of pickup.

Ownership of the firearm transfers only after the background check and legal transfer process is completed at the FFL dealer’s location. Transfer or service fees charged by the receiving dealer are your responsibility.

Background Checks and Documentation

All firearm transfers require completion of legally mandated background checks and forms. You agree to fully cooperate with all compliance procedures, including completing federal and state documentation and presenting valid identification.

If you fail a background check, decline to complete required paperwork, or are otherwise denied transfer:

  • The sale will be canceled
  • The firearm will be returned to us
  • Shipping and restocking fees may apply

We cannot transfer a firearm without full legal approval.

Order Accuracy

You are responsible for reviewing your order carefully before checkout. This includes confirming the correct firearm model, specifications, shipping details, and selected FFL dealer information.

Once a firearm has shipped or a transfer has begun, changes may not be possible. Orders placed in error may be subject to cancellation or restocking fees.

Final Sale Policy for Firearms

All firearm sales are considered final once the transfer has been completed. After you take possession of the firearm, it cannot be returned or exchanged due to legal and safety regulations.

If a firearm is defective or has a manufacturer issue, service or repair may be handled through the manufacturer’s warranty program. We will assist in directing you to the appropriate support channel when possible.

Safe Handling and Storage

By purchasing a firearm, you acknowledge that firearms must be handled responsibly and safely at all times. You agree that you are solely responsible for:

  • Safe handling and operation
  • Proper storage to prevent unauthorized access
  • Compliance with all local laws regarding transport and storage
  • Obtaining any required permits or licenses

We strongly encourage firearm safety training and the use of appropriate safety devices such as locks and safes.

Prohibited Conduct

Firearms purchased from us may only be used for lawful purposes. You agree not to:

  • Transfer the firearm to prohibited individuals
  • Modify or use the firearm illegally
  • Provide false information during the purchase process
  • Attempt to bypass legal requirements

We reserve the right to refuse service or cancel transactions suspected of unlawful intent.

Limitation of Liability

Battle Creek Firearms Co. is not responsible for the misuse, negligent handling, unauthorized modification, or illegal use of any firearm or related product after transfer. You assume all responsibility and liability once possession has been accepted.

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from the purchase or use of firearms.

Order Refusal or Cancellation

We reserve the right to refuse or cancel any firearm order at our discretion, including situations involving:

  • Suspected fraud
  • Legal restrictions
  • Compliance concerns
  • Pricing or inventory errors
  • Incomplete documentation

If we cancel an order before transfer, any eligible payment will be refunded according to our policies.

Agreement Acceptance

By completing checkout, placing an order, or accepting transfer of a firearm from Battle Creek Firearms Co., you acknowledge that you have read and agree to this Firearms Sale & Checkout Agreement and accept full responsibility for complying with all applicable laws and safe firearm practices.
